Terms and Conditions

General:

  1. By using this site and any other sites, accounts or services I manage, you declare to have read, understood and agreed to follow and be bound by the Terms and Conditions listed here in this document. If you do NOT agree to these terms, then I must respectfully ask you to discontinue your use of all of my services.

  2. I reserve the right to change, edit and/or discontinue any services or terms listed in this document, on this site or any other place I sell my wares or services; with or without notice. If I do modify my terms, I will update the "Terms Last Updated" date and renew the link to download said terms on my site. If you do NOT agree with the modified terms, please cease to use my services.

  3. Anyone who has an open commission with me, initiated from before any of the aforementioned changes, will be bound by the previous version of the terms and conditions; the terms they read and agreed to at the time of beginning that commission. Any commissions thereafter will be subject to the new, revised terms.

  4. All of the content displayed and sold on my websites, my accounts (Instagram & Facebook) and my services (Gumroad & Etsy Store) is designed and created by myself unless otherwise specified; any reproduction or duplication of ideas, concepts, products or images displayed on these sites, (in whole or in part) is forbidden without permission, written or oral, from me, the artist, Jessy Scribbles/Jessica Tomey.

  5. I am open for business and available to talk from 10am - 6pm every weekday, 1pm - 5pm on Saturdays and I am unavailable on Sundays. The days I take off in the year are as follows; 21st Dec - 1st Jan(Christmas time), Easter Bank Holiday weekend(Good Friday, Easter Sunday and Easter Monday) and the 20th of May(my Birthday).

  6. I have the right to refuse service to you for any reason, particularly if I find that you're behaving rudely towards me or being generally derogatory towards me, my abilities, my prices, etc.

  7. Please do not use any of the contact methods that I have provided on this site or any other site or account I run for spamming me, chain-mailing, sending me unsolicited pictures/links/videos, any kind of fraudulent acts, or to dox me in any way, shape or form. One of these has happened to me so I will stress this to you now; I put my contacts on my sites specifically for business and business only. If you just want to talk with me, we can talk via DMs on my personal Instagram account; @jessysdribbles.

  8. Following this, if you do use my contact details for any of the aforementioned acts, I reserve the right to block and report you and blacklist you from using any/all of my services.

  9. All addresses given for the shipping of your purchases are used for shipping purposes only; none of the addresses I receive for shipping will be logged/kept or intentionally used in ANY other way.

Purchases:

  1. When ordering products from my store, if you would like a refund after the point of ordering and receiving the product, you will need to send your purchase back to me, fully intact and in good condition.

  2. Once you have received your purchase and it is no longer in my possession, I am no longer liable for any breakages, damages or any wear and tear of the product that it may obtain from that moment forward. If however you product arrives at your door, damaged, I am more than happy to work with you to help resolve the issue if needed.

Private, Non-Profit Commissions

General:

  1. You understand and agree that by commissioning me, through applying through this site (my website) or through contacting me in person, via email or direct message (through text message, social media message, etc) you declare to have read, understood and consented to be bound by the Terms and Conditions listed here in this document. If you do NOT consent to these terms, then I must respectfully ask you not to commission me or use any of my services.

  2. Following that, I reserve the right to refuse service to and/or blacklist any person or company who breaks any of the terms and conditions in this document, and I reserve the right to refuse any commission if I do not agree/feel comfortable with the subject matter or premise of the work.

  3. To avoid any disappointment with orders you may make, please ask all of your questions before placing your order.

  4. Before any commission, I will give you a rough time-frame in which you can expect to receive your order. If your order is done before that time, I will be in contact and you can get your commission before the estimated deadline at a slightly discounted price.

  5. Please note that the time it takes me to create orders may be subject to many factors; one example being how complex your order or how many parts your order has, others being general things such as drying time of glue, setting time of the clay I use or purchasing materials. This time frame can vary between 1-7 days, 3-9 weeks or more depending on what you've ordered from me.

  6. In accordance with the term above, any time that I temporarily cannot continue work on a clay model commission due to purchasing parts or drying and setting time will be factored out of your final commission costs. If I'm able to work on separate parts of the commission during this drying time, this factoring out may not happen.

  7. If I am experiencing high commission volumes, your commission might have to be put on a waiting list until current commissions are finished.

  8. Once I have given you your completed commission and it is no longer in my possession, I am no longer liable for any breakages, damages or any wear and tear of the commission that it may obtain from that moment forward.

  9. In accordance with the term in the section at the top of this document with regards my business hours and holidays, If ANY order, especially a clay chibi or anime figure, is placed close to or after the 10th of December of any given year, you might be expected to wait until the 2nd of January that following year due to the holiday closing time. I will do my best to get it done before the 24th of Dec but if that doesn't happen then you'll have to be happy to receive your order after Christmas.

 

Reference Images and Appearance:

Conditions for Clay Models:

  1. When commissioning a clay model, please note that once an order is placed, the confirmation is given and the modelling has commenced, the order cannot then be cancelled or transferred for another item; there will also be no refund past the point of confirmation.

  2. There will be no rush orders available on any clay commissions; when the model is complete, it will be given to you.

  3. When ordering a Clay Chibi Model, please be aware that these models have no predominant facial features that have to be formed in clay (e.g, eyelids, lips, teeth, nose, brows, chin…)

  4. I will not make Clay Chibi Models sitting down unless they are modelled sitting/kneeling on a table-top. This however brings the height limit down to approximately 7cm - 10cm from the table-top up to the top of the head.

  5. I will make Clay Anime Models sitting down however, sitting/kneeling characters have a height limit of approximately 14cm - 20cm from the table-top up to the top of the head.

  6. Clay Chibi Models will not be made including fabric; they will mostly consist of just clay, clay and wire, clay and cotton wool (where smoke needs to be modelled), and/or clay and plastic (where glasses or umbrellas need to be modelled).

Conditions for Hand Drawn Commissions:

  1. When commissioning any hand drawn commission from me (other than sketch commissions), once the drawing is at a stage where you are happy for me to start solid linework and colouring, the order cannot then be cancelled, changed or transferred for another item; there will also be no refund past this point of confirmation.

  2. When ordering a sketch commission from me, please note that I do not draw fully fledged backgrounds for these types of commissions; you may ask me to draw some very simple, plain assets that the characters are interacting with (i.e: chairs, tables, coffee mugs, small plants and flowers, small items of food and fizzy drinks cans) but no more than that.

Conditions for All Commissions:

  1. Any full-sized anime model, chibi model or hand drawn art commission you may order from me will be characterised caricatures based on the reference photos/images you provide and not an exact like-for-like representation of the subject it’s made of.

  2. Whatever reference images you give/tell me to use will influence how the end result I draw or sculpt will look; I cannot create something out of nothing, so if I don't have the reference pictures of, for example; "your cousin's favourite hairpin she likes to wear", I can't create that. If you want it drawn or made, show it in your reference images; and if it's a make-up or hairstyle look, preferably ON the person you want drawn/sculpted

  3. When ordering a model or hand drawn piece of art of yourself, a member of family, a friend or any character/subject of your choosing, you must provide as many reference photos as you can of the subject. These include:

Models Specifically:

​

  • Full body photos; Front, Back, Left and Right side. (preferably all in ‘A’ pose) Example of ‘A’ pose. -->

  • Full face photos; Front, Left and Right side. (all with neutral expression)

  • Close ups of hair. (if you want me to better capture your hair in clay, please take front, back left and right photos of your hair.)

  • Close ups of any items on the body. (this includes items held; such as coke cans, folders, umbrellas, etc, and items worn; like glasses, rings, backpacks, headbands if intricately patterned, etc.)

  • Close ups of shoes, any notable designs or markings on your outfit and anything that has a distinct and/or intricate pattern on it.

  • Example of what kind of pose you want your subject in (can be drawn or photographed)

  • Example of what kind of facial expression you want (can be drawn or photographed)

Just Drawings:

​

  • Full body photos; Front, Back. (preferably in ‘A’ pose)

  • Full face photo; Front. (with neutral expression)

  • Close ups of any items on the body. (like glasses, rings, backpacks, umbrellas, headbands if intricately patterned, etc.)

  • Example of what kind of pose you want your subject in (can be drawn or photographed)

  • Example of what kind of facial expression you want (can be drawn or photographed)

 

*I might be lenient about the amount of reference images if the commission is a drawing, but if it's a clay model you will need to send me all the reference images you can. This is so that I can create the artwork for you with the most accuracy that I can.*

4. When it comes to your photos, wear whatever clothes you want your model to be wearing or send me some good, high quality image references of what you want your model to be wearing if you don’t have the outfit or if it doesn’t exist in real life.

My Limitations:

Even though I try my absolute best to fulfil everybody's wishes within their commissions, there are certain things that I cannot draw either due to explicit nature or due to my skills in that particular area of art not being good enough to sell commissions by. Here is a list of some of the things that I CAN and WILL draw, as well as a list of things I CANNOT and WILL NOT draw.

Things I WILL / CAN draw:

  • Human / Humanoid Characters (Male, Female and Androgynous)

  • Kemonomimi (Human Characters with animal ears and tail)

  • Cartoon/Chibi Animals (you'd still need to talk to me about what kind of animal it is to be sure if I can draw it)

  • Couples (Hetero, Gay, Lesbian, any are fine)

  • Nudity & Modest Lewd Art (JUST so long as it's done tastefully and the "important parts" are covered somehow.)

  • Small amounts of Gore or Blood

  • Simple/Moderate Scenery (Inside of a Bathroom, Bedroom, Living Room, Calm/Moderately Busy Street Scene, Small Shop Interior, certain Park/Woods like scenes; you'd need to discuss it a little more with me to see what I'd be able to draw for you)

Things I WON'T / CAN'T draw:

  • Mechas (Think Gundam Wing, Tiger & Bunny or Transformers; I need more practice...)

  • Pornographic or Fetish Content (No... Just... I won't do it in commissions...)

  • Vehicles (I need MUCH MORE practice to even think about drawing any vehicle in a commission)

  • Sonic Style Characters (I've tried, I don't know why but I just can't draw them...)

  • Complex Scenery (Busy Town Streets, Garages [see Vehicles], any crowded/highly detailed scene really)

  • Anthro Characters (Until I get better at drawing them, I will not sell them as commissions UNLESS they are SCULPTED.)

  • Realistic/Semi-Realistic Animals (I need more practice to sell ANY commission of an animal.)

  • Extreme Gore/Viscera

I can sculpt anything for you in clay apart from Pornographic or Fetish Content, Sonic Style Characters, Realistic/Semi-Realistic Animals, Mechas and Extreme Gore/Viscera. Anything else I will do my best for you to create.

Commission Payment (all commissions):

  1. I charge for all commissions by a daily rate and my daily rate for private commissions is £100 per day.

  2. When you are sure that you want to commission me and you know what you'd like me to create for you, I will give you a loose overview of the final price for your commission based on the amount of time it will take for me to make it before I start.

  3. Once you have agreed that you want to proceed with the commission and we have worked out the pricing, I will send you an invoice to pay a down payment of the first half a day's worth of commission price (£50) which you must pay within the first week of it being sent to you; this down payment is also non-refundable if you decide you don't want to proceed with the commission after I have received your payment and started your commission.

  4. When the commission that you have asked for is complete, I will send/give you the finished piece, and I will send you the final payment invoice which you will be required to pay within the first ten days of it being sent to you unless we have agreed otherwise via email and/or text/social media messages (this will be recorded on your invoice for that commission in particular).

Changes to Order (Hand Drawn commissions specific):

  1. When commissioning all drawings (apart from sketch commissions), I will draft up an initial sketch of your order and allow you to have a look at it before I finish and colour the drawing. At this point you are allowed one free minor change on said sketch (changes allowed listed below). Any other changes after this will incur an additional payment of half a day's worth of work (£50) per change which will be added to your final payment.

  2. The changes allowed for any drawing include;

​

  • Re-positioning of single limbs.

  • Minor hair style change (i.e, change the fringe or the back of the hair)

  • Small facial expression changes (close/open one eye, change the mouth, tweak one eyebrow, add blush lines or cheek marks...)

  • Minor clothing changes (change the cut of t-shirt around neck, length of top or length of sleeves, change style of trousers, make something more/less scruffy/ripped and change the desired colour of something.)

  • Adding an item (has to be worn by subject or attached to clothing or body)

 

You cannot at this stage ask me to scrap the entire drawing and draw something new, unless you want to cancel your commission and start again. This does however mean that you'll lose your £50 down payment which is non-refundable so please, know what you want or at least have a solid idea of what you want before you commission me.

Privacy:

  1. All reference photos given will be stored securely and will be deleted upon completion of the order.

  2. None of the photos given will be used for anything other than the creation of your model, unless you personally give me permission to use them in anything else.

  3. None of the photos given of real people will be given to any other parties; they will solely lie in my possession.

  4. I reserve the right to post any pictures of the commission that you ordered from me to my website, portfolio or my social media for non-profit purposes. Even though the character or ideas in the drawing may not be mine, the drawing was created by me and therefore, I have the right to post them.

Commercial Artwork

While most, if not all, of the terms above do still apply when hiring me as a freelancer, there are a couple of other things you should bear in mind that are specific to my freelance work;

​

  • When you email me with regards to a business commission, please provide a link to or evidence of your website, project(s) I might be providing for, or LinkedIn for proof of your legitimacy as a business.

  • Please bear in mind that prices for commercial work are higher than that of my personal commissions; there's an 80% mark-up in price to be expected per singular commission requested within. (e.g: A commission that costs £500 in total [5 days' work], for somebody ordering privately, would cost a commercial buyer £900.) The reason for this higher price rate is that I am handing you the commercial rights to reproduce and sell that final, finished piece of artwork I created indefinitely.

  • If you need to hire me for ongoing work/multiple projects (work that may span anywhere between a few weeks, a few months or possibly even a year or more) my daily rate is £180 per day.

  • If you have a deadline you need me to work within, please let me know within the first email so that I can let you know as soon as possible whether or not I will be able to do this work for you.

  • When you are sure that you want to commission me and you know what you'd like me to create for you, I will give you an overview of the final price for your commission based on how long I estimate it to take me to complete before I start work.

  • Once you have agreed that you want to proceed with the commission, I will send you an invoice to pay a down payment of the first day's worth of the commission price which you must pay within the first week of it being sent to you, unless we have agreed to a different payment method. This down payment is non-refundable as I would have started your commission at this point. Please bear this in mind before you decide to proceed with the commission.

  • When the commission that you have asked for is complete, I will send you the finished piece and send you the final payment invoice which you will be required to pay within the first ten days of it being sent to you.

  • I will not post any pictures of the finished commercial work that you ordered from me anywhere on social media unless I have been given the right to post them, by you, the client.

  • That being said, I do still own creative rights to the artwork created and therefore, I have the rights to use the commission I made you as portfolio material after the commission is completed and given to you. If you have a problem with this arrangement, please let me know in the first email you send; we can come to some agreement.
